Website Terms of Use

These terms govern your use of the rohcode website at rohcode.com (the "Website"). Please read them carefully. By using the Website or creating an account, you agree to these terms.
The purchase of our services is governed by a separate Client Services Agreement, which sets out the full contract between us and our clients. These Website Terms of Use cover your use of the Website itself.
1. Who we are
The Website is operated by Ryan O'Hanlon, trading as rohcode, a sole trader based in Ireland ("rohcode", "we", "us", "our"). Our full postal address is available on request. You can contact us at ryan@rohcode.com.
2. Using the Website
You may use the Website to browse our component catalog, view pricing, create an account, submit build orders, and manage your projects. You agree to use the Website only for lawful purposes and not to:
- attempt to gain unauthorised access to the Website, our systems, or other users' accounts;
- interfere with or disrupt the Website's operation or security;
- use the Website to transmit unlawful, harmful, or infringing material;
- copy, scrape, or reproduce the Website, its catalog, or its content except as expressly permitted.
3. Accounts
To use certain features you must create an account. You are responsible for keeping your login details secure and for all activity that occurs under your account. You must give accurate information when registering and keep it up to date. Tell us promptly at ryan@rohcode.com if you believe your account has been accessed without your permission.
4. The catalog and pricing
The component catalog, prices, and descriptions on the Website are provided to help you plan and place an order. Prices shown are indicative and may change. The price that applies to your project is the price confirmed at the point you submit and pay for your build order. rohcode is not currently registered for VAT, and prices are therefore not subject to VAT at this time; this may change if and when rohcode becomes VAT-registered, and any applicable VAT will be shown before you pay.
Submitting and paying for a build order creates a contract governed by the Client Services Agreement. Nothing on the Website is a binding offer until your order is accepted.
5. Intellectual property
The Website and everything on it — including the component catalog, designs, code, text, graphics, and the rohcode name and branding — is owned by rohcode or its licensors and is protected by intellectual property law. You may not copy, reproduce, or reuse any part of it except as expressly permitted by us in writing.
The ownership of work we build for clients is dealt with separately in the Client Services Agreement. In summary: clients receive a licence to use the website we build and host for them for as long as their plan is active; the underlying rohcode component library remains owned by rohcode and is never transferred; and a client's own content and domain remain the client's property.
6. Acceptable use of services
Websites we build and host are subject to our Acceptable Use Policy, which sets out what may and may not be published. Use of our services in breach of that policy may result in suspension.
7. Availability and disclaimers
We work to keep the Website available and accurate, but we provide it "as is". We do not guarantee that the Website will always be available, uninterrupted, or error-free, and we may suspend, withdraw, or change any part of it. Information on the Website is provided for general purposes and does not constitute professional advice.
8. Our liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence or for fraud.
Subject to that, and to the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data, or business, arising from your use of the Website.
If you are a consumer, nothing in these terms affects your statutory rights, which always apply in addition to these terms.
9. Your rights as a consumer
If you are buying as a consumer (that is, not for purposes related to your trade, business, or profession), you may have a statutory right to cancel a distance contract within 14 days. Because our services involve us beginning work quickly, you will be asked, at the point of purchase, to expressly request that we begin work without waiting and to acknowledge that you lose the right to cancel once the service has been fully performed (that is, once your website is delivered and live). If you cancel before work is fully performed, you may be charged a proportionate amount for work already done. Full details are set out in our Refund Policy and the Client Services Agreement.
If you are buying as a business, the 14-day cancellation right does not apply, and refunds are governed by our Refund Policy and the Client Services Agreement.
10. Links to other websites
The Website may link to external sites we do not control. We are not responsible for their content or practices, and including a link does not imply our endorsement.
11. Privacy
Your use of the Website is also governed by our Privacy & Cookie Policy, which explains how we handle your personal data and the cookies we use.
12. Changes to these terms
We may update these terms from time to time. The "last updated" date shows when they last changed. Your continued use of the Website after a change means you accept the updated terms.
13. Governing law
These terms are governed by the laws of Ireland. Disputes are subject to the jurisdiction of the Irish courts. If you are a consumer, you may also have the right to bring proceedings in your own country of residence, and this clause does not remove any protection available to you under the law of that country.
